Hello, this is Dr. Grande. Today I will analyze the case of Marsha Kelly. First, I’ll look at the background of this case, move to the timeline of the crime, then offer my analysis. Marsha Gail Kelly was born on December 21, 1970, and lived in Cushing, Texas. Evidently, Marsha prefers her name to be pronounced Marseilles, but this is confusing considering the spelling.
I will just call her Marsha. When she was young, Marcia was extremely rebellious and sensation seeking. At the age of 17, she married. After having two daughters, Marca divorced. When she was 21 years old, Marcia met a man named James Kelly while attending a local street race. They dated on and off for the next several years.
During this time, Kelly had a third daughter with a different man, and James had two sons with a different woman. In 1995, Marsha’s middle daughter and her mother died in a house fire caused by an electrical problem. This tragedy had a substantial impact on Marsha’s oldest daughter, Shaina Sepovado, who ended up spending some time in a mental health facility.
Marca became a respiratory therapist and worked in a local hospital. She also ran her own bounce house business, which not surprisingly was a bit up and down. After spending some time in jail, her on-again off-again lover, James, found some clarity as far as his career. He started his own short hall trucking company and eventually owned three tractor trailers.
Marcia and James decided to form a committed romantic relationship. They moved into a double wide trailer which was on property where various relatives lived. In February 2003, the couple married. Marsha’s daughter Shaina did not respond well to the new living situation. She was rebellious just like her mother. When she was 14 years old, Shaina moved in with her boyfriend only to move home a few weeks later.
At the age of 16, she moved out again. This time with her 23-year-old boyfriend, Dallas Christian. Dallas had experienced negative contact with law enforcement in the past. He was the type of offender who required registration. Despite this shocking history, Marca was fine with the arrangement. On October 5, 2005, Marca and Shaina engaged in physical combat after Shaina refused to clean her room.
The mother and daughter were still fighting when the police arrived. Shaina was arrested and eventually put on juvenile probation. Now, moving to the timeline of the crime. On Saturday, October 22, 2005, Marcia Kelly went to work an overnight shift at the hospital. James Kelly was also working. He was performing maintenance on his trucks. At 3:30 a.m., now on Sunday, October 23, James went to sleep. Right before this, on a phone call with his wife, Marsha, he asked her if she could wake him up at 7:30 a.m. Later that morning, Marca called David Bone, who was the stepfather of James and only lived a few hundred yards away from the double Y trailer, and asked him to wake up James.
David drove a lawn tractor over to the trailer and entered, but was unable to wake up James because he was dead. At 8:20 a.m., David called 911. When the police arrived, they found James Kelly dead in his bedroom, just like David reported. While sleeping in his bed, James had been shot once in the face with a rifle chambered in 3030 Winchester.
This rifle was not found at the scene. Right away, the police suspected Marsha’s 16-year-old daughter, Shaina. They interviewed her, her 23-year-old boyfriend, Dallas Christian, and a 15-year-old friend named Colton Weir. Shaina and Dallas said they had been driving around on back roads and drinking at the time of the murder. Colton, however, had a different story.
He confessed to murdering James. Here is what Colton said happened during the early morning hours of October 23, 2005. Colton, Shaina, Dallas, and two other friends named Gary and Billy drove to James Kelly’s double wide trailer. Dallas was the driver of the vehicle. Upon arrival, Colton and Shaina made their way into the trailer.
Shaina showed Colton where her stepfather, James, was sleeping. Colton went into the bedroom and shot James one time in the face. At this point, Shaina and Colton returned to the vehicle and placed the rifle in the trunk. Dallas drove the group to the Goodman Bridge where Colton threw the rifle into the middle of the Angelina River.
Colton claimed that Marsha and Shaina orchestrated the murder. He was promised $10,000 and a dualy pickup truck in return for killing James. The police found the rifle in the river where Colton said it was. Later, Shaina and Dallas confessed to the murder as well. When the police spoke to Marca, she denied involvement, but admitted that she overheard some of the young people making a statement about wanting to kill her husband.
Despite her denial, investigators believed Marsha was the mastermind of the murder. They charged her, Shaina, Colton, and Dallas with capital murder. Marsha’s trial started on July 31, 2006. On August 4 of that year, she was convicted of capital murder. Her sentence was life in prison without the possibility of parole. In November 2006, Colton was convicted of capital murder.
And in April 2007, Shaina met the same fate. They were both sentenced to life in prison without the possibility of parole. However, on appeal, their sentences were reduced to life in prison with the possibility of parole. Both of them will become eligible for parole in October 2045. In 2008, Dallas Christian pleaded guilty to first-degree murder and was sentenced to 40 years in prison.
So, he was offered a plea deal which avoided him being convicted of capital murder. His projected release date is in December 2045, but he could be released up to 20 years earlier. Now, moving to my analysis, Marcia Kelly maintains her innocence, and she has a few supporters. They argue there is no credible evidence tying her to the murder of her husband, James Kelly.
The state of Texas, of course, disagrees. They believe that Marsha had been desperately seeking someone to kill her husband and finally accomplished her goal. This brings me to the question, is Marsha guilty of murder? Let’s take a look at the evidence both for and against the idea that she is guilty. Starting with the inculpatory factors, Marsha had a tumultuous relationship with her husband James, characterized by frequent arguing about how to deal with Shaina’s rebellious behavior.
They disagreed about punishment. Marcia didn’t really want there to be any punishment and James did. There was a $100,000 life insurance policy on James. Marsha could collect this money upon his death. Marcia admitted that she asked men to kill her husband. Two men testified that Marcia offered them money and equipment like trucks and jet skis to murder James. These were separate incidents.
So Marca asked one man and then on another occasion asked the other man. Marcia admitted that she overheard the young people talking about committing murder. The teenager who shot James to death, Colton Weir, said that Marca offered him money and a truck to carry out the murder. Marcia called her daughter Shaina right before and right after the murder.
James Kelly’s cell phone was found next to his bed. It had been used to call Marsha at 3:56 a.m. on the day of his murder. The police did not believe that he made the call. By this time, James was supposed to be asleep. This makes it seem like maybe Shaina called Marsha using that phone so Marsha could hear the murder take place, like she wanted to hear the rifled discharge.
Moving to the exculpatory factors, Marcia had an alibi for the time of the murder. She definitely did not personally participate. Although Marca admitted asking men to kill her husband, she claimed that she was not being serious. Marsha’s involvement in the murder was not necessary to give Shaina a motive.
Shaina already hated James Kelly and wanted him dead in order to gain her freedom. When Marsha was on trial, Shaina testified that her mother was not involved in any way. Marsha never offered anybody anything to carry out the murder. Furthermore, Shaina said that there was no plan. The murder was spontaneous. Considering all the evidence in this case, do I believe that Marcia Kelly is guilty of murder? I don’t believe the state has a great case against her, but I do believe that Marca is guilty beyond a reasonable doubt.
The most persuasive evidence was how on two occasions independent of her interaction with Colton, Marsha offered men money and equipment to kill her husband. This makes it seem like she wanted this to happen for some time. What do I think happened in this case? This is just a theory, my opinion.
Marcia Kelly was greatly affected by the loss of her middle daughter in the houseire. Again, her mother died in the same fire. She knew that Shaina took this loss particularly hard, and Marca was afraid of alienating her. The parenting style that Marca adopted involved zero supervision. Marsha let Shaina do whatever she wanted.
For example, Shaina drove a car at the age of 15 with no driver’s license. She regularly smoked, drank, and missed school. And she spent time with her 23-year-old boyfriend, who had been convicted for victimizing a four-year-old. Marsha did not focus on correcting Shaina’s behavior. Rather, her efforts were dedicated to finding a way to murder James.
Committing homicide was something that Marca and Shaina could agree on. They may have argued frequently and viciously, but not on that point. Both of them wanted James to make a permanent exit from this world. Marsha wanted money in the form of a life insurance payout, and Shaina wanted freedom. Marcia tried to recruit two different men to carry out the homicide, but was unsuccessful.
When she approached Colton Weir with an offer, he was more than happy to help. Colton was Shaina’s friend and appeared to be attracted to her. He was described as socially immature, extremely gullible, and possessing below average intelligence. When Marca went to trial, her daughter Shaina testified to protect her.
This was surprising to the prosecution, but it should not have been. A characteristic of many toxic mother-daughter relationships is a high degree of loyalty. The two women were tied together through their dysfunction. They had an unbreakable bond. With this in mind, was there any way that James Kelly could have predicted his own murder? Could this homicide have been avoided? James was not a particularly sophisticated individual, and the nuances of interpersonal dynamics may have escaped him.
It was probably difficult for him to recognize the alliance between Marsha and Shaina because it appeared as though they hated each other. Shaina was even on juvenile probation for attacking her mother physically. Despite his failure to appreciate the dynamics, James probably did recognize that Marsha did not like him very much, and he certainly knew that Shaina was not a member of his fan club.
The part that he didn’t understand was how Marsha and Shaina were willing to work together toward a common goal, namely his murder. James realized that individually they may have been out to get him, but he did not comprehend the combined forces component. Even if he had contemplated the existence of a conspiracy, murder is such an extreme and rare behavior, I doubt James would have ever suspected that he was in danger.
I think the lesson learned this case is that chaotic environments can lead to unexpected hazards. When Marsha chose not to supervise Shaina, this seemed to be just a motheraughter problem. It was confined to their relationship and some misbehavior, but it would not have wider implications. It was inconvenient and frustrating, but not lethal.
In reality, the problem was much larger and was able to expand into the realm of homicide. Those are my thoughts on the case of Marcia Kelly. Thank you so much for watching. I’ll talk to you soon.
